on the Establishment of a Legal Entity under Public Law Kutaisi International University

Article 1 – Purpose of the Law
The purpose of this Law is to determine legal characteristics of the establishment and operation of the Legal Entity under Public Law Kutaisi International University (‘the University’) as an educational complex for fundamental and applied sciences.

Article 2 – Legal grounds for the activities of the University
1. Legal grounds for the activities of the University are: the Constitution of Georgia, the international agreements of Georgia, this Law, the statute of the University and other legal acts.
2. The current legislation of Georgia in the fields of science and education shall apply to the University by taking into account the characteristics determined by this Law.

Article 3 – Legal status and structure of the University
1. The University is a legal entity under public law, independent from state government bodies, and subject to state control by the Government of Georgia, and established by this Law, which delivers educational programmes and conducts scientific research independently.
2. The structure of and powers of the structural units of the University, as in a higher educational research institution, shall be determined by the statute of the University, which shall be approved by the Government of Georgia upon the recommendation of the executive director of the University (‘the Executive Director’) in agreement with the International Advisory Council of the University (‘the International Advisory Council’) and the Scientific Council of the University (‘the Scientific Council’).
3. The University shall be considered as authorised upon the approval of the statute of the University and of the regulations of the Scientific Council.

Article 4 – Goals and fields of activities of the University
1. The goals of the University are: creating an up-to-date scientific and theoretical, and experimental base to ensure the existence of an efficient model for the integration of science and education in Georgia; developing higher education and interdisciplinary study and research programmes; fostering the training of highly qualified scientific personnel and the development of innovation economics.
2. Fields of activities of the University are: providing opportunities for the implementation of multi-profile, multi-methodological, and interdisciplinary scientific research on the basis of the development of research infrastructure; introducing research outcomes in medicine and other sectors of science, training the competitive personnel in the specialisations such as physics, chemistry, biology, computer science and engineering, and awarding them relevant academic degrees.
3. The joint educational and research programmes between the University and other research and educational institutions shall be carried out on the basis of mutual agreement.

Article 5 – Functions of the University
The functions of the University are as follows:
a) supporting the development of scientific research in relation to the Hadron therapy method;
b) determining the fundamental research fields on the basis of the business profile of the University and gaining international recognition; encouraging students to develop their personal potential and creative skills and to gain competences in compliance with modern requirements;
c) training the research personnel and ensuring appropriate conditions for carrying out up-to-date scientific and experimental research;
d) ensuring appropriate conditions for the continuous improvement of the quality of education and science;
e) delivering Doctoral educational programmes, Master’s educational programmes, Bachelor’s educational programmes and postgraduate research programmes;
f) facilitating the introduction of technologies;
g) participating in international scientific research and carrying out activities coordinated with donor organisations;
h) creating disciplinary and interdisciplinary educational programmes and determining new directions for scientific research;
i) carrying out consulting activities with foreign partners, and collaborating with other international educational and scientific organisations.

Article 6 – University management bodies
The management bodies of the University are: the Executive Director, the International Advisory Council and the Scientific Council.

Article 7 – Executive Director
1. The Executive Director shall be appointed for a five-year term of office and may be dismissed by the Prime Minister of Georgia, upon the recommendation of the Scientific Council.
2. The Executive Director shall:
a) manage the activities of the University and represent it in the relations with third parties;
b) conclude transactions, contracts, and agreements on behalf of the University in academic and scientific fields in the country as well as abroad;
c) make decisions and issue individual legal acts within its authority;
d) prepare the statute of the University and submit it for approval to the Government of Georgia in agreement with the International Advisory Council and the Scientific Council;
e) select candidates for the membership of the International Advisory Council from among the world's leading scientists, and nominate them to the Scientific Council for approval;
f) create teaching and scientific research quality assurance mechanisms on the basis of the recommendations of the International Advisory Council;
g) approve educational programmes in agreement with the International Advisory Council and the Scientific Council;
h) determine international partnership relations;
i) review the opinions and recommendations of the International Advisory Council;
j) organise conferences, seminars, symposia and other events;
k) manage the funds and property of the University according to the procedures established by the legislation of Georgia;
l) exercise other powers determined by the statute of the University and the legislation of Georgia.

Article 8 – International Advisory Council
1. The Scientific Council, upon the recommendation of the Executive Director, shall approve the composition of the International Advisory Council for a five-year term.
2. The International Advisory Council is a body for the control of quality of teaching and scientific activities of the University, which shall:
a) assess the compliance of the educational programmes with the requirements for external referral and peer review;
b) approve the statute of the University;
c) carry out periodic monitoring of educational and scientific activities of the University and discuss results of such monitoring during conferences.
3. Other powers and rules of procedure of the International Advisory Council shall be determined by regulations of the International Advisory Council, which shall be approved by the International Advisory Council upon the recommendation of the chairperson of the International Advisory Council.
4. The International Advisory Council shall elect the chairperson of the International Advisory Council for the term of office of the International Advisory Council from among the members of the International Advisory Council by a majority of votes.

Article 9 – Scientific Council
1. The Scientific Council is a self-government body of the University. The Scientific Council comprises the persons holding the scientific and academic positions of the University (professors and emeritus professors) who directly participate in the educational process or carry out scientific research. A meeting of the Scientific Council shall be convened once a month. An extraordinary meeting of the Scientific Council shall be convened at the request of the Executive Director.
2. The chairperson of the Scientific Council shall head the meetings of the Scientific Council, who shall be elected by the Scientific Council from among its members by a majority of votes.
3. The Scientific Council shall:
a) review and approve the strategic development plan of the University;
b) approve the statute of the University;
c) approve the composition of the International Advisory Council;
d) select a candidate for Executive Director according to the procedures established by the statute of the University and nominate him/her to the Prime Minister of Georgia for appointment to the office;
e) exercise other powers determined by the statute of the University.

Article 10 – Specifics of the educational activities carried out by the University
1. The University shall deliver higher educational programmes and postgraduate research programmes independently, in compliance with international standards, which may not be lower than the standards established by the state in the relevant field.
2. The University shall develop procedures for the employment of persons with academic degrees (scientific staff, post-doctoral students, associated employees and other persons) on the basis of term labour agreements.
3. The procedure for the election of professors, and matters related to the awarding of academic degrees, recognising academic credits and other organisational and structural matters associated with the activities of the University shall be determined by the statute of the University.
4. The International Advisory Council shall, on the basis of the recommendation of the Executive Director, assess the compliance of educational programmes with the requirements for external referral and peer review. In the case of a positive opinion of the International Advisory Council, the educational programmes shall be approved by the Executive Director, following which the educational programmes shall be considered accredited.
5. The educational programmes delivered by the University shall be recognised by international accreditation agencies within 10 years after their accreditation.
6. The University may establish additional requirements to be introduced at the University in appropriate fields for doctoral students, and candidates for doctor's and master's degrees, as well as for entrants.
7. The document certifying an academic degree (diploma) awarded by the University shall be issued for persons who have completed a full course of relevant educational programmes delivered by the University as provided for by the legislation of Georgia.
8. The document certifying an academic degree (diploma) awarded by the University shall be recognised by the state.

Article 11 – Property of the University
The state shall transfer appropriate property to the University upon its foundation according to the procedure established by the legislation of Georgia.

Article 12 – Financing of the University
1. The sources of financing of the University are:
a) target funds allocated from the state budget of Georgia;
b) income received from the works performed under contracts;
c) grants;
d) donations;
e) other income permitted by the legislation of Georgia.
2. The funds and income provided for by paragraph 1 of this article shall only be used for the achievement of the goals of the University and for the performance of its functions.

Article 13 – State control of the University
1. The Government of Georgia shall carry out state control over the University.
2. The Executive Director shall, once a year, submit to the Government of Georgia a report on the activities implemented by the University.

Article 14 – Procedures for the termination of activities and for the liquidation of the University
Termination of the activities of the University and its liquidation shall be carried out according to the procedures established by the legislation of Georgia.

Article 15 – Transitional Provisions
1. The Prime Minister of Georgia shall:
a) appoint the Executive Director within 10 days after the entry into force of this Law, before the appointment of the Executive Director according to the procedure determined by Article 7(1) of this Law;
b) appoint the Chairperson of the International Advisory Council within 10 days after the entry into force of this Law, before the appointment of the Chairperson of the International Advisory Council according to the procedure determined by Article 8(4) of this Law;
c) approve members of the International Advisory Council upon the recommendation of the Chairperson of the International Advisory Council within one month after the appointment of the Chairperson of the International Advisory Council, before approval of the members of the International Advisory Council according to the procedure determined by Article 8(1) of this Law.
2. The Government of Georgia shall approve the statute of the Institute of Technology upon the recommendation of the Executive Director, within three months after the appointment of the Executive Director, before the approval of the statute of the Institute of Technology according to the procedure determined by Article 3(2) of this Law.

5. The manager of state property shall ensure the transfer of relevant property to the Institute of Technology within one month after its request.

Article 16 – Entry into force of the Law
1. This Law, except for Article 5(e) of this Law, shall enter into force on the 15th day after its promulgation.
2. Article 5(e) of this Law shall enter into force on 1 January 2017.

О создании юридического лица публичного права – Кутаисского международного университета

Статья 1. Цель Закона (1.11.2019 N5274)
Целью настоящего Закона является определение правовых особенностей создания и функционирования юридического лица публичного права – Кутаисского международного университета (далее – Университет) как фундаментального и прикладного научно-образовательного комплекса.
Статья 2. Правовые основы деятельности Университета (1.11.2019 N5274)
1. Правовыми основами деятельности Университета являются: Конституция Грузии, международные договоры Грузии, настоящий Закон, Устав Университета и другие правовые акты.
2. Законодательство Грузии, действующее в сфере образования и науки, распространяется на Университет с учетом особенностей, определенных настоящим Законом.
Статья 3. Правовой статус и структура Университета (1.11.2019 N5274)
1. Университет является учрежденным на основании настоящего Закона юридическим лицом публичного права, функционирующим отдельно от органов государственного управления, находящимся под государственным контролем Правительства Грузии, которое самостоятельно осуществляет образовательные программы и научные исследования.
2. Структура Университета как высшего образовательного исследовательского учреждения и полномочия его структурных единиц определяются Уставом Университета, который по согласованию с Международным советом советников Университета (далее – Международный совет советников) и Ученым советом Университета (далее – Ученый совет) и по представлению исполнительного директора Университета (далее – исполнительный директор) утверждает Правительство Грузии.
3. Университет считается авторизованным с момента утверждения Устава Университета и Положения об Ученом совете.
Статья 4. Цели и сферы деятельности Университета (1.11.2019 N5274)
1. Целями Университета являются: создание современной научно- теоретической и экспериментальной базы для обеспечения эффективной модели интеграции образования и науки в Грузии; развитие программ высшего образования и межотраслевых учебно-исследовательских программ; содействие подготовке высококвалифицированных научных кадров и развитию инновационной экономики.
2. К сферам деятельности Университета относятся: обеспечение на основе развития исследовательской инфраструктуры возможности для осуществления многопрофильных, многометодических, межотраслевых научных исследований, внедрение результатов исследований в медицине и других отраслях науки, подготовка конкурентоспособных кадров по следующим специальностям: физика, химия, биология, компьютерные науки и по инженерным специальностям и присвоение им соответствующих академических степеней.
3. Совместные образовательные и исследовательские программы между Университетом и другими образовательными и исследовательскими учреждениями осуществляются на основе взаимного согласия.
Статья 5. Функции Университета (1.11.2019 N5274)
К функциям Университета относятся:
а) содействие развитию научных исследований, связанных с применением метода адронной терапии;
б) определение направлений фундаментальных исследований исходя из профильного направления Университета и получение международного признания; содействие студентам в реализации личностного потенциала, развитии творческих умений и навыков и получении компетенций, соответствующих современным требованиям;
в) подготовка исследователей и создание для них условий для проведения современных научно-экспериментальных исследований;
г) создание условий для непрерывного повышения качества образования и науки;
д) осуществление докторских образовательных программ, магистрантских образовательных программ, образовательных программ бакалавриата и исследовательских программ после получения высшего образования;
е) содействие внедрению технологий;
ж) участие в международных научных исследованиях и осуществление координированной деятельности с организациями-донорами;
з) создание отраслевых и межотраслевых образовательных программ и определение новых направлений научных исследований;
и) осуществление консультационной деятельности с иностранными партнерами, сотрудничество с другими международными образовательными и научными организациями.
Статья 6. Органы управления Университета (1.11.2019 N5274)
Органами управления Университета являются: исполнительный директор, Международный совет советников и Ученый совет.
Статья 7. Исполнительный директор
1. Исполнительного директора по представлению Ученого совета на 5-летний срок назначает на должность и освобождает от должности Премьер-министр Грузии.
2. Исполнительный директор: (1.11.2019 N5274)
а) руководит деятельностью Университета и представляет его в отношениях с третьими лицами;
б) заключает от имени Университета сделки, договоры и соглашения в академической и научной сферах как внутри страны, так и за ее пределами;
в) в пределах своей компетенции принимает решения и издает индивидуальные правовые акты;
г) разрабатывает Устав Университета и по согласованию с Международным советом советников и Ученым советом представляет его на утверждение Правительству Грузии;
д) подбирает из числа ведущих ученых мира кандидатов в члены Международного совета советников и представляет их на утверждение Ученому совету;
е) на основании рекомендации Международного совета советников создает механизм обеспечения качества обучения и научных исследований;
ж) по согласованию с Международным советом советников и Ученым советом утверждает образовательные программы;
з) определяет международные партнерские отношения;
и) рассматривает заключения и рекомендации Международного совета советников;
к) организует проведение конференций, семинаров, симпозиумов и других мероприятий;
л) распоряжается средствами и имуществом Университета в порядке, установленном законодательством Грузии;
м) осуществляет другие полномочия, предусмотренные Уставом Университета и законодательством Грузии.
Статья 8. Международный совет советников
1. Состав Международного совета советников по представлению исполнительного директора на 5-летний срок утверждает Ученый совет.
2. Международный совет советников является органом, контролирующим качество обучения и научной деятельности Университета, который: (1.11.2019 N5274)
а) дает оценку соответствия образовательной программы требованиям внешнего реферирования и коллегиальной взаимооценки (Peer Review);
б) одобряет Устав Университета;
в) осуществляет периодический мониторинг образовательной и научной деятельности Университета и рассматривает его результаты на конференциях.
3. Другие полномочия и порядок деятельности Международного совета советников определяются Положением о Международном совете советников, которое по представлению председателя Международного совета советников утверждает Международный совет советников.
4. Международный совет советников из своего состава на срок полномочий Международного совета советников, большинством голосов избирает председателя Международного совета советников.
Статья 9. Ученый совет
1. Ученый совет является самоуправляющимся органом Университета. В состав Ученого совета входят лица, занимающие в Университете научные и академические должности (профессора и эмеритус-профессора), которые непосредственно участвуют в образовательном процессе или ведут научные исследования. Заседания Ученого совета созываются раз в месяц. Внеочередные заседания Ученого совета созываются по требованию исполнительного директора. (1.11.2019 N5274)
2. Руководит заседаниями Ученого совета председатель Ученого совета, которого избирает Ученый совет из своего состава большинством голосов.
3. Ученый совет: (1.11.2019 N5274)
а) рассматривает и утверждает план стратегического развития Университета;
б) одобряет Устав Университета;
в) утверждает состав Международного совета советников;
г) подбирает в порядке, определенном Уставом Университета, кандидатуру исполнительного директора и представляет ее для назначения на должность Премьер-министру Грузии;
д) осуществляет другие полномочия, предусмотренные Уставом Университета.
Статья 10. Особенности образовательной деятельности, осуществляемой Университетом (1.11.2019 N5274)
1. Университет осуществляет высшие образовательные программы и исследовательские программы после получения высшего образования самостоятельно, в соответствии с международными стандартами, которые не могут быть ниже стандартов, установленных государством в соответствующей сфере.
2. Университет разрабатывает порядок приема на работу по срочным трудовым договорам лиц с академическими степенями (научный персонал, постдокторанты, ассоциированные сотрудники и другие лица).
3. Порядок избрания профессора, вопросы присвоения академической степени, признания учебных кредитов и другие организационно-структурные вопросы, связанные с деятельностью Университета, определяются Уставом Университета.
4. Международный совет советников на основании представления исполнительного директора дает оценку соответствия образовательной программы требованиям внешнего реферирования и коллегиальной взаимооценки (Peer Review). В случае положительного заключения Международного совета советников образовательную программу утверждает исполнительный директор, после чего она считается аккредитованной.
5. Образовательные программы, осуществляемые Университетом, в 10-летний срок после аккредитации должны быть признаны международными аккредитационными агентствами.
6. Университет вправе устанавливать дополнительные требования по приему в Университет для докторантов профильного направления, кандидатов в докторанты и магистранты, а также абитуриентов.
7. Документ, удостоверяющий присвоенную Университетом академическую степень (диплом), выдается лицам, которые в порядке, установленном законодательством Грузии, прошли полный курс соответствующей образовательной программы Университета.
8. Документ, удостоверяющий присвоенную Университетом академическую степень (диплом), признан государством.
Статья 11. Имущество Университета (1.11.2019 N5274)
При учреждении Университета государство передает ему соответствующее имущество в порядке, установленном законодательством Грузии.
Статья 12. Финансирование Университета (1.11.2019 N5274)
1. Источниками финансирования Университета являются:
а) целевые средства, выделяемые из государственного бюджета Грузии;
б) доходы от выполнения работ по договору;
в) гранты;
г) пожертвования;
д) другие доходы, разрешенные законодательством Грузии.
2. Средства и доходы, предусмотренные пунктом первым настоящей статьи, в полном объеме используются для осуществления целей и выполнения функций Университета.
Статья 13. Государственный контроль за деятельностью Университета (1.11.2019 N5274)
1. Государственный контроль за деятельностью Университета осуществляется Правительством Грузии.
2. Исполнительный директор раз в год представляет Правительству Грузии отчет о деятельности, осуществленной Университетом.
Статья 14. Порядок прекращения деятельности и ликвидации Университета (1.11.2019 N5274)
Прекращение деятельности и ликвидация Университета осуществляются в порядке, установленном законодательством Грузии.
Статья 15. Переходные положения
1. Премьер-министру Грузии:
а) в 10-дневный срок после введения настоящего Закона в действие назначить исполнительного директора до назначения на должность исполнительного директора в порядке, установленном пунктом первым статьи 7 настоящего Закона;
б) в 10-дневный срок после введения настоящего Закона в действие назначить председателя Международного совета советников до избрания председателя Международного совета советников в порядке, установленном пунктом 4 статьи 8 настоящего Закона;
в) в месячный срок после назначения председателя Международного совета советников, по представлению председателя Международного совета советников утвердить состав Международного совета советников до утверждения состава Международного совета советников в порядке, установленном пунктом первым статьи 8 настоящего Закона.
2. Правительству Грузии в 3-месячный срок после назначения исполнительного директора, по представлению исполнительного директора утвердить Устав Технологического института до утверждения Устава Технологического института в порядке, установленном пунктом 2 статьи 3 настоящего Закона.

5. Управляющему государственным имуществом обеспечить передачу Технологическому институту соответствующего имущества в месячный срок после его требования.
Статья 16. Введение Закона в действие
1. Настоящий Закон, кроме подпункта «д» статьи 5 настоящего Закона, ввести в действие на 15-й день после опубликования.
2. Подпункт «д» статьи 5 настоящего Закона ввести в действие с 1 января 2017 года.
