LAW OF GEORGIA

ON REGISTRATION FEES

 

 

Article 1 - General provisions

This Law, in accordance with Article 94 of the Constitution of Georgia and the Law of Georgia on the Basic Principles of the System of Fees, defines the types and rates, and the procedure and deadlines for the payment of the fees set for registration as established by law.

 

Article 2 - Concept of a registration fee and payers of a registration fee

A registration fee is a mandatory payment to the Budget of Georgia, which is payable by natural and legal persons in accordance with the procedure and in the amount established by this Law, for granting the right to carry out activities and/or to use products and goods provided for by law, as well as for services provided to natural and legal persons by state bodies.

 

Article 3 - Procedure for paying a registration fee and transferring it to the Budget

1. A registration applicant shall be obliged to pay a registration fee established by this Law.

2. No person shall be obliged to pay a registration fee not provided for by this Law.

3. Registration fees shall be paid before registration in cash or non-cash form.

4. Non-cash payments shall be made in accordance with existing procedures.

5. Cash payments shall be made in national currency in banks, through the issuance of a receipt in an established form.

6. A registration applicant shall be obliged to submit to a registration authority a receipt confirming the payment of a registration fee, along with other documents determined by legislation.

7. Registration fees shall be transferred to the State Budget according to the procedures established by the laws of Georgia.

Article 4 - Grounds for refusing registration

1. A registration authority shall refuse to provide registration to a person if:

a) the submitted documents are not in conformity with the norms established for the respective registration;

b) the presented products and goods are not in conformity with the norms established for the respective registration;

2. Amounts paid in excess of fees shall be refunded by registration authorities to registration applicants within 20 days after the receipt of their written applications.

 

Article 5 – Exemptions from the payment of registration fees

1. Exemptions from the payment of registration fees shall be established only by this Law.

2. Granting individual exemptions from the payment of registration fees shall be impermissible.

 

Article 6 - Procedure for resolving disputes related to registration fees

1. Disputes related to registration fees shall be resolved in court in accordance with the procedures established by the legislation of Georgia.

2. Initiating proceedings in court shall not release a person from the obligation to pay the registration fee at issue.

 

Article 7 - Types and rates of registration fees; government institutions authorised to provide registration

1. The National Bank of Georgia shall register securities and offers in accordance with the legislation of Georgia on securities, the amount of registration fee shall be 0.1% of the total value of the securities, up to a maximum of GEL 5,000.

2. The legal entity under public law called the National Agency of Public Registry operating under the Ministry of Justice of Georgia shall provide the following types of registration:

a) registration of political associations of citizens - GEL 500;

b) introduction of changes to the statutes of political associations of citizens or to data provided for in Article 22(2)(e)-(g) of the Organic Law of Georgia on Political Associations of Citizens, which are subject to registration in the Registry of Political Associations of Citizens (Parties) - 25% of the fee established for the registration of political associations of citizens.

3. The relevant services of the Ministry of Internal Affairs of Georgia shall provide the following types of registration:

a) re-registration of a light vehicle body - GEL 40;

b) re-registration of a truck cabin or frame - GEL 32;

c) re-registration of a body of a van truck or bus - GEL 63;

d) re-registration of an engine of a means of transport - GEL 38.

4. The relevant service of the Ministry of Culture of Georgia shall provide the registration of cultural values to be exported abroad, whose registration fee shall be GEL 15.

6. The relevant services of the Ministry of Labour, Health and Social Affairs of Georgia shall provide the following types of registration:

a) registration of a pharmaceutical product upon its first-time import through the recognition regime of state registration (except for the proactive registration of a pharmaceutical product by an interested person irrespective of the purpose of its import, and the authorisation of an already registered pharmaceutical product with different packaging and labelling through the notification procedure) - GEL 500;

b) registration of an innovative (new and original) pharmaceutical product through the national regime of state registration - GEL 2500;

c) repeated registration of an innovative (new and original) pharmaceutical product through the national regime of state registration - GEL 2000;

d) registration of a generic and repeatedly manufactured pharmaceutical product and a blood preparation through the national regime of state registration - GEL 500;

d1) repeated registration of a generic and repeatedly manufactured pharmaceutical product and a blood preparation through the national regime of state registration - GEL 200;

e) registration of an immunobiological preparation through the national regime of state registration - GEL 500;

f) repeated registration of an immunobiological preparation through the national regime of state registration - GEL 200;

g) registration of a radiopharmaceutical product through the national regime of state registration - GEL 500;

h) repeated registration of a radiopharmaceutical product through the national regime of state registration - GEL 200;

i) registration of diagnostic products: test systems (according to nosologies) and sets of allergens, reagents (for clinical biochemistry and clinical chemistry) and sera, through the national regime of state registration - GEL 400; and the state registration of each position contained therein through the national regime – an additional GEL 10;

j) repeated registration of diagnostic products: test systems (according to nosologies), and sets of allergens, reagents (for clinical biochemistry and clinical chemistry) and sera, through the national regime of state registration - GEL 200; and the registration of each position contained therein through the national regime of state registration – an additional GEL 10;

k) registration of a dental product through the national regime of state registration - GEL 500;

l) repeated registration of a dental product through the national regime of state registration - GEL 200;

m) registration of mechanical contraceptive devices (excluding non-invasive mechanical contraceptive devices) through the national regime of state registration - GEL 500;

n) repeated registration of mechanical contraceptive devices (excluding non-invasive mechanical contraceptive devices) through the national regime of state registration - GEL 300;

o) registration of medical items through the national regime of state registration - GEL 1000;

p) repeated registration of medical items through the national regime of state registration - GEL 250;

q) registration of modernised models of medical items through the national regime of state registration - GEL 330;

r) registration of single-use medical items through the national regime of state registration - GEL 500;

s) repeated registration of single-use medical items through the national regime of state registration - GEL 125;

t) registration of modernised models of single-use medical items through the national regime of state registration - GEL 170;

u) registration of second level changes in registration documentation through the national regime of state registration - GEL 50;

v) voluntary registration of a complementary medicinal product through the national regime of state registration - GEL 400;

w) repeated voluntary registration of a complementary medicinal product through the national regime of state registration - GEL 200;

x) voluntary registration of a paratherapeutic product through the national regime of state registration - GEL 500;

y) repeated voluntary registration of para-medications through the national regime of state registration - GEL 300;

z) voluntary registration of a biologically active additive through the national regime of state registration - GEL 600;

z1) repeated voluntary registration of a biologically active additive through the national regime of state registration - GEL 400.

7. The tax authorities of Georgia shall provide the following types of registration:

a) registration of the following enterprises:

a.a) an unlimited company - GEL 60;

a.b) a limited partnership - GEL 80;

a.c) a limited liability company - GEL 160;

a.d) a joint stock company - GEL 360;

a.e) a cooperative - GEL 120;

b) registration of a branch of an enterprise - 50% of the fee established for the registration of an enterprise having a respective organisational and legal form;

c) making of changes and/or additions to the statute of an enterprise or its branch - 25% of the fee established for the registration of an enterprise having a respective organisational and legal form;

d) registration of the termination of activities and liquidation of an enterprise - 25% of the fee established for its registration;

e) repeated registration of an enterprise due to changes introduced in the legislation of Georgia - 20% of the fee established for its primary registration;

f) registration of an alteration to the organisational and legal form of an enterprise - the fee established for the registration of a legal person having a selected organisational and legal form.

9. The relevant service of the Ministry of Finance of Georgia shall provide the following types of registration:

a) granting registered mark codes, and year of manufacture codes, and registration of a single stamp - GEL 15;

b) annual registration of a single stamp of a registered mark imprint - GEL 10.

10. Legal entities under public law within the Ministry of Economy and Sustainable Development of Georgia shall provide the following types of registration:

a) Maritime Transport Agency - registration of ships sailing under the flag of Georgia (except row boats and motor boats) - USD 80 equivalent in GEL plus:

Article 8 – Exemptions from the payment of registration fees

The payment of registration fees shall not apply to:

a) first and second line heirs when registering numbered vehicle units received as a gift or by inheritance under a notarial procedure, in the cases provided for in Article 7(3)(a)-(d) of this Law;

b) local self-governing units when registering basic property, as well as ownership rights to plots of land and associated immovable property, including the preparation of cadastral maps, the completion of registration cards, the issuance of registration certificates and other activities necessary for registration as provided for by the legislation of Georgia.

Article 81 - Transitional provision

1. All information available in the Public Registry where rights in rem are registered and in institutions engaged in registering and recording these rights before the entry into force of the Civil Code of Georgia shall be transferred in an authenticated form to state authorities and local self-government and government bodies, and courts, and legal persons facilitating the system of land registration, free of charge.

5. The Ministry of Justice of Georgia shall be assigned to prepare a draft law on the Fee Established for Services Provided by the National Agency of Public Registry before 1 November 2004.

6. Before 1 January 2021, the National Bank of Georgia shall register securities and offers in accordance with the legislation of Georgia on securities without charging the registration fee established by Article 7(1) of this Law.

Article 9 - Final provisions

1. This Law shall enter into force on the 15th day after its promulgation.

2. The following shall be deemed invalid from the date this Law enters into force:

a) Article 38(2) of the Law of Georgia on Medicines and Pharmaceutical Activities;

b) Resolution No 196 of the Cabinet of Ministers of the Republic of Georgia of 11 April 1995 on the Establishment of Registration Fees for the Registration of Enterprises and Social Associations of Citizens;

c) Decree No 139 of the President of Georgia of 19 May 1996 on the Registration of Motor Vehicles, Number Plates, and Preparation, Issuance and Recording of Driving Licences and Vehicle Registration Certificates;

d) the List of Tariffs for the Registration and Service of Means of Transport, Trailers and Numbered Vehicle Units on the Basis of a Joint Application of Parties Submitted to the Road Police, approved by Order No 587 of 9 July 1996, and Order No 693 of 19 August 1996 and Order No 215 of 30 April 1997 of the Minister of Internal Affairs of Georgia;

e) Edict No 321 of the President of Georgia of 14 May 1996 on Registration Fees for Firearms and Gas Spray Guns;

f) Resolution No 747 of the Cabinet of Ministers of the Republic of Georgia of 6 December 1995 on the Establishment within the Ministry of Culture of the Republic of Georgia of a Division Regulating the Evaluation, Taking out and Bringing in of Cultural Values;

g) the List of Prices for Paid Services Provided by Quality Inspectorates Located at Border Checkpoints in Customs Control Areas and Terminals upon the Export and Import of Goods, and the List of Prices for Registering Veterinary Preparations and for Conducting Expert Examinations, approved by Order No 2-424 of the Minister of Agriculture and Food of 11 December 1997;

h) Procedures for the Registration of Therapeutic Agents in Georgia, approved by Order No 360/ო of the Minister of Healthcare of Georgia of 17 September 1997;

i) the Law of Georgia on State Registration Fees for Plots of Land and Associated Immovable Property;

j) all other legislative and subordinate acts related to the establishment of registration fees.
